By accessing or using BuildModo (the "Service"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.
BuildModo provides an AI-powered platform to generate, host, and maintain custom apps based on your prompts and configuration. We may modify, suspend, or discontinue any part of the Service at any time.
The Service is intended for business use only. By using it, you confirm that you are acting for purposes relating to your trade, business, or profession and not as a consumer, and that you have authority to bind the business on whose behalf you use the Service.
You must be legally able to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
Some features require a paid subscription. If you start a free trial, it will convert to a paid subscription at the end of the 14-day trial period unless you cancel before the trial ends. Subscriptions renew automatically until canceled. You can cancel at any time to avoid future charges.
Fees are billed in advance and are non-refundable except as required by law. You are responsible for applicable taxes. We may change pricing with reasonable notice.
If a payment fails and is not successfully retried, we may suspend or cancel your subscription. Section 5 describes what happens to your apps when a subscription ends.
When your subscription ends, whether because you canceled or because payment failed, your hosted apps stop running. Apps installed on your stores, and features of your mobile apps that rely on BuildModo-hosted services, may stop working from that point.
We keep your apps and their data for up to 30 days after your subscription ends so you can resubscribe and continue where you left off. After that period, they are permanently deleted. If your plan includes source code export, it is your responsibility to export any code you want to keep before your subscription ends.
Each plan includes a maximum number of apps, stores, and data storage, as described on our pricing page. Apps of every type count toward your plan's app limit, including mobile apps: a mobile app uses one of your plan's app slots rather than adding to them.
Mobile apps are available on the Builder and Pro plans only. The Builder plan includes one published mobile app and the Pro plan includes up to two. A published mobile app means one mobile app, built for one store, submitted to the App Store, Google Play, or both. Publishing more than your plan includes requires a higher plan or a separate agreement with us. We may meter and enforce these limits, and we may change them with reasonable notice.
Producing store builds and submitting apps to the App Store and Google Play require an active paid subscription and are not available during a free trial. You are responsible for your own Apple Developer and Google Play accounts, their fees, and compliance with their terms and review policies.
The Service uses artificial intelligence to generate code, content, and configuration, including apps ("Output"). The Output may contain errors or security vulnerabilities, may not behave as you intended, and may differ between similar requests.
You are responsible for reviewing and testing the Output before using it with a live store or with real customers, and for the results of apps you install or publish, including changes they make to store data, themes, products, orders, and customer records. The Output is provided subject to Section 13 (Disclaimer of Warranties) and Section 14 (Limitation of Liability).
You agree not to misuse the Service. You will not:
You own your content and data you provide to the Service ("Customer Content"). You also own the custom apps generated specifically for you, excluding BuildModo’s underlying platform, templates, and proprietary tooling. BuildModo owns the Service, including all software, interfaces, and brand elements.
Ownership of your apps does not by itself entitle you to export their source code. Source code export is available on the plans described on our pricing page.
You grant BuildModo a limited license to host, process, and use Customer Content to provide the Service. You grant BuildModo the right to use feedback you provide without restriction.
The Service integrates with third-party services such as Shopify and other providers. Your use of those services is subject to their terms and policies. BuildModo is not responsible for third-party services or outages. You agree to comply with the terms and policies of the third-party services that the Service integrates with.
To the extent BuildModo processes personal data on your behalf, including data about your store customers processed by apps we host for you, you are the data controller and BuildModo is a processor. You agree to comply with applicable privacy laws and to obtain any required consents. For that processing, this Section forms the data processing agreement between you and BuildModo under Article 28 of the General Data Protection Regulation (GDPR). BuildModo will:
Some features may be offered as beta or early access. These features are provided "as is" and may be changed or discontinued without notice.
The Service, including all Output, is provided on an "as is" and "as available" basis. BuildModo disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted or error-free, or that the Output will be accurate, secure, or suitable for your purposes.
To the maximum extent permitted by law, BuildModo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or related to the Service will not exceed the amount you paid to BuildModo in the twelve months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless BuildModo and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses arising out of your use of the Service, apps you install or publish, or violation of these Terms.
You may cancel your subscription at any time from your account settings. We may suspend or terminate your account at any time and for any reason, including if you breach these Terms, fail to pay fees when due, or if we are required to do so by law. If we terminate your account for a reason other than your breach of these Terms or failure to pay, we will refund the unused portion of any fees you have prepaid. Upon termination, your right to use the Service ends, and Section 5 applies to your apps and data.
We may modify these Terms from time to time. We will post the updated Terms and update the "Last updated" date. If changes are material, we will provide reasonable notice.
These Terms are governed by the laws of Greece, without regard to conflict of law principles. The courts of Piraeus, Greece, have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service.
These Terms, together with our Privacy Policy, are the entire agreement between you and BuildModo regarding the Service and replace any prior agreements on that subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it.
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
Sections 5, 7, 9, 11, 13, 14, 15, 18, and 19, and any unpaid payment obligations, survive termination of these Terms.
